Abstract
工业化和城镇化的发展,对土地的利用逐渐由平面向地上和地下空间延伸,形成垂直式的分层立体利用,空间权概念也应运而生.尽管关于土地空间权的法律制度在西方国家早已建立,但在我国至今仍不健全,且不同层面和人群对空间、空间权的概念及理论问题尚有较大争议.因此,在土地空间开发实践不断深化的当前,应加强城市土地空间权制度构建和土地利用潜力研究.
